We suggest that Brandeis provide a model for lawyers who are considering embedding their personal values – rather than fading – and finding resources in those values that reinforce professional commitments. This would extend beyond Jewish lawyers to those who justify their role in moral responsibility, feminism, racial justice, LGBTQ rights and civics, and religious advocacy. In comparison, the whitewashed approach offers at best ambiguous support for professional values beyond the role of neutral party. Moreover, it is based on erroneous assumptions – not all lawyers are fungible in their abilities and all lawyers have idiosyncratic personal values that they exercise within the broad discretion offered by ethical rules. In fact, sociological research shows that lawyers who take a whitewashing approach are generally less likely to treat clients and colleagues with an open mind than lawyers who openly admit their biases while trying to treat others with an open mind. However, we recognize that in relatively rare circumstances, lawyers will not be able to successfully integrate their personal and professional values. In these circumstances, lawyers must abide by professional values or risk professional sanctions. before the 12th century, in the sense defined in the transitive sense 1 Louis D. Brandeis questions the prevailing view that lawyers “whitewash” their personal identity of their professional identity, in the words of Sanford Levinson. According to the lawyer`s dominant neutral partisan view, clients will receive the same representation required for equal justice only if lawyers exclude personal and group identification from their role. Brandeis, on the other hand, claimed that his Jewish identity constituted his image of himself as a lawyer. His remarkable career thus offers a counter-narrative to the fading that can serve as a model for all lawyers, regardless of their personal and collective identity. To develop an understanding of Brandeis, we examine how Brandeis and his biographers described his Jewish identity. Although Brandeis has explicitly described his professional commitment to the equality of justice and the common good as rooted in his Judaism, almost all of his biographers focus on the content of Brandeis` Judaism and find it inauthentic. Our focus on professional identity allows us to analyze Brandeis` Judaism without questioning its authenticity. Instead, we point out how Brandeis explicitly recognized Judaism`s defining influence on the construction of one`s professional self, and how this approach to identity collided with that of the now dominant whitewashing perspective. This was the only sign she had given so far that she had gained her white hair by age and not by bleach.
